Do I need an ACHD permit to put a porta potty on the street?

The Ada County Highway District (ACHD) controls public streets, sidewalks and shoulders in all of Ada County. A porta potty in the street, on a sidewalk or on a shoulder needs an ACHD Temporary Use Permit. Complete ACHD applications get a review within 5 working days. A driveway or yard spot needs no ACHD permit.

ACHD covers the streets in Boise, Meridian, Eagle, Kuna, Star and Garden City. The cities do not issue right-of-way permits for those roads. Apply on the ACHD permitting page or call ACHD at 208-387-6100.

Give a street spot at least one week of lead time. Work usually starts the business day after ACHD approves and you pay. Our Boise porta potty permit guide walks through the forms.

Who sets the rules for a big public event in Ada County?

Boise requires a special event permit for public-property events over 1,000 people, filed at least 60 days ahead. That site plan must show every portable toilet and hand-wash station. Central District Health licenses food vendors at Ada County events. Plan at least 1 accessible unit in each cluster of toilets.

City of Boise: Large public events file a site plan that marks restroom spots.
Boise Parks and Recreation: The park use form asks how many regular and accessible toilets you will bring.
Central District Health: Central District Health handles food licensing in Ada, Boise, Elmore and Valley counties.
ADA rule: At least 5% of units in each cluster must be accessible. A cluster of 10 needs 1.
